I am in a big dilemma after completing my bachelor a month ago. I applied for OPT, and its not there yet. All the Universities are going to start from January.

--->  If my OPT is denied , will I be out of status (F1) ?

---> How soon do I have to apply for master to remain in F1 status ?

I talked with USCIS and 4 different people give me different answers. If anybody has gone through this problem before , please help me.

Why Don't you apply Kaplan . they have classes starting from Fe bMarch. for GMat courses . It a nine month class. and they will give you I-20 in one week

Sajhafan, I suggest you not to take a chance. Just find out one cheap community college get admission just to remain on status. If you get opt then you can ignore the admission. Sometimes luck just do not come our way, so be well prepared for the worst case scenario also and make sure you remain on status.

Why will your OPT deny? I don't think so Consult with your school's International office.

They should have some suggestion

When did u apply for opt?It takes 3 month period for your process.You can also find out by logging to their website.I'm sure that u must have received some kind of letter from usics saying that they have received your application and 'll hear from them in 3 month .But usually it wont take long. They are not supposed to denied ur opt because it is your right to get your opt after graduating. My best advice is go to your intl student adviser and talk to them.GoodLuck.

It may be more helpful if have mentioned the different answers you got from USCIS officer. We may be advising as they had advised you.

I'm not sure why you are worried about your OPT not being approved. It should usually be approved within 6-8 weeks. Don't worry and open an account with USCIS to follow up with your case status.

I agree with anupbhandari and kazitman. OPR processing time is usually 90 days, whichis alos indicated in the USCIS and your OPT application form. They will grant you OPT,so don't worry too much, it might just be little late with the holiday season going on.You can consult your international advisor to feel better; however, if you get admissioninto any college and get a new I-20, you OPT status will be immediately voided. OPTholders cannot attend college while in OPT status or their OPT status will be voided.So, talk to International Advisor before you make any decisions.Good Luck!

Thank you for your replies. I never thought that it would be so difficult to get few information regarding immigration.........on a simple issue like mine. Some say I need to join college (just is case), some say I dont, some say I have only two months left as a f1 student after I graduate..............but finally I get my answer after going through USCIS website...................

(ii) Change in educational levels : An F-1 student who continues from one educational level to another is considered to be maintaining status, provided that the transition to the new educational level is accomplished according to transfer procedures outlined in paragraph (f)(8) of this section.

(F)(8):
           A student who is maintaining status may transfer to another Service approved school by following the notification procedure prescribed in paragraph (f)(8)(ii) of this section. However, an F-1 student is not permitted to remain in the United States when transferring between schools or programs unless the student will begin classes at the transfer school or program within 5 months of transferring out of the current school or within 5 months of the program completion date on his or her current Form I-20, which ever is earlier......

If your application is OK, u should get it. I know a couple of friends who graduated in August but got OPT in mid of november. they applied late. But be safe, taee ho.
