Hi there, Maile nepal ma diploma in nursing gareko, ma sanga nepal ma kam gareko 2yrs experience cha. i have got RN license from here . tara maile yeha associate degree matra gareko chu. now, i am in opt, employer says that they help me out but you have to hire lawyer by yourself. Can i hire lawyer and apply for h1b? tara h1 apply garna atleast US bachelors degree hunu parcha re. Please help me out with my questions. i would really appreciate for suggestions. thanks

In order to qualify for H-1B visa, you must have US equivalent to Bachelor's degree which can be obtained through academic course work or experience. One year of university education is equivalent to 3 years of work experience in the related field. So do your math and see what position is being offered to you. If you have 2-year education here in the US along with degree from Nepal plus at least relevant 3 yrs of work experience could result into US equivalent Bachelor's degree. Please keep in mind that the nature of job being offered must match with the degree and work experience you have acquired. Good Luck!

Keshab u hit the bull's eye. Most of the nursing jobs in US need associate degree. For H1b you have to have at least bachelors degree. So even if you do bachelors degree here in US, it is very hard to find nursing jobs that need bachelors qualification and for H1b you need at least bachelors. So finding a job which needs bachelors degree is tough. So getting a job and having bachelors degree does not make you eligible to apple for H1b, it is also the job qualification requirements. I don't mean to discourage you but only want to make you clear.

Thank you Mr. Kesab. So i have to submit proof of my work expriences right. Do USCIS take care of evaluating whether i have equivalant US bachelors degree? I do have 3 years of experience in Nepal. overall, do you think i am good for h1. thanks.

????, Even holding a bachelor degree from US does't make you qualify for H1b. USCIS has different rule for Nursing professional. To apply for H1b under nursing category, your job should be highly critical or your must be administrative nursing Position. Holding RN and Bachelor degree alone doesn't make you qualify for the H1b. You must have job in hand for such a position. Sorry for the truth, but this is the real truth. Check USCIS website for nursing h1b

The best option for you is H1C. But unfortunately, the H1C visa classification expired on December 20, 2009 and has not been renewed by Congress. So your best bet is toapply for dependent visa under your husband if ur married and wait for the H1C petition to start again.
