I went for H1B stamping at the end of January this year and I do had a long gap in my employment after OPT. This triggers the visa officer and gave me 221g. She told me to provide all the relevant documents from last 5 years to verify whether to approve the H1B or not. It was very stressful because it was hard to contact the employer and get all the relevant documents of backdated time. But I did not loose hope and slowly started gathering documents as much as I can and submit it after 2 weeks and waited for the response. After two and half weeks I was granted visa. I was lucky enough this time. From my experience, If you have an long employment gap or you have join the college(non-credible) just for CPT purposes, then it would definitely haunt you back during the interview and it would be very difficult to get visa. Else if there is no employment gap, you have worked in OPT and then applied for H1B and working currently, then there will be no issues, you can go freely and get stamped easily. Above are the individual opinion based upon my experience.

Guys, I am going in April for H1B stamping and am trying to know how many days it takes from the day you take the date, to your interview to the day the passport is available. I am trying to take the least amount of days off from my work so I want to know how much I should plan for. I'm thinking about taking 2 weeks off. Will that be enough? Thanks!

@hkrishna In my experience, 2 weeks will be a very tight timeline for you. Sometimes it takes more than 2 week of time to get an appointment. So, I suggest you to make an online appointment before you go Nepal. I went in December 2014 and I didn't make online appointment. When I went for an appointment, I got date after 2 weeks. Also now a days it takes 3 business days to get visa in your hand.

You can fill up the visa application online before you depart to Nepal. You can also call Nabil bank in Maharajgunj where you can ask them the trend of Interview Dates given after Paying for Interview Fee. Once you file application online, you can ask your friends or relatives to pay the Fee at Nabil bank and book your interview date. You can arrange your Interview date the day after you land KTM. If PIMS require, it might take 3/4 additional days otherwise you are straight. Good Luck, BTW I am also going in April n again Stamping, It's fun LOL. The above was my experience on April 2014. I appear in the interview 2 days after I landed.

I did the same thing in Jan.. Both hkrishna and C. Ronaldo.. What I did was, 1) I filled the form DS-160 online. COmpleted the form. 2) Went to this website and created the account to schedule interview. It would basically ask for your confirmation no from DS-160 and your basic information. << wait 24 hours filing DS160>> http://www.ustraveldocs.com/np/ .. then from there you can get CGI receipt, 3) Ask someone from nepal to pay for that CGI receipt. (FYI: It will be expiry date), if expired, generate again. 4) once paid, after few(give 24 hrs), you come back to the same website, and schedule your interview. << Be sure to save the receipt as you need to present during interview day).. FYI: We pay in the investment bank , NO MORE IN NABIL BANK. 5) Once approved, basically they say 3 days, but I got the next day only. I got email saying pick up your document from Investment bank in Durbar marg. Then done. Yes 2 weeks is enough if you do the above steps,. Before going nepal if you have interview date, that is perfect. I went for two weeks, even got married and came back :) Any question buzz me : amriju {at} gmail.com

Hkrishna, Whatever amriju said is correct. I also did the same with one more step. I scheduled interview 8 days after I was supposed to land in Nepal. And on day 1 I applied for MRP. In 1 week I got the MRP and then in US embassy, I told them to stamp on my new password and for that I needed to update DS160 online on the same day. And now I have new visa on my new passport. And also you need to go for Labor permit from Shram bibhag in thahachal near red cross building. And that will take one whole day (This part really sucks though)

NE_Patriots, I am planning exactly like you have done. I wanted to have a new stamp on my MRP too as I have to apply MRP this time. So, I wanted to get MRP before interview. Can you explain the process of getting MRP? Thanks

Ronaldo, Sure. Make sure you have your original Nagarikta otherwise they will give you hard time. Then you need to go to Department of passport at Narayanhiti (It is opposite to kesar mahal in thamel). You will have so many small stalls who will take your picture and fill form for Rs 300. Then you will have to stand in couple of lines and finally pay Rs 10,000 and they will give you a slip with the due date. And come on that date and time to collect new passport. Also, ladies line will always be shorter so if you can go with a lady friend then let her submit your forms as well. I did the same and mine was done in like 2 hours otherwise be prepared to waste whole day there.

In my case, I did ds160 before the marriage, but got the interview date after the marriage. And the interview date was almost 2 weeks (this was still when you would go to Nabil bank to get dates), and we were flying back in a week. A simple email explaining the situation with copies of air tickets helped and they called for interview in 2 days and we flew in a week. It was close but we made it. I would suggest file ds160 now, and get date after marriage. I think these dates you get dates online.

Stupida, Did you file you ds160 as single or married. And was it single application or two different applications that you filed. Thank you Stupida for quick response.

I don't recall, but it I think I should have definitely done as married and put the date of future, the day we got married. It was a single application. I just checked my DS160 confirmation, it doesn't say married or single. But Even putting a single should have no impact on your application. You can always explain the situation if they had some questions. But if you are so much in doubt just do after marriage and email them to get earlier dates. They had helped me twice moving my dates earlier.

Because 'Texas' is the Confederate state who fought the Union Soldier for right to own a 'Person', now at present 'Texas' is a leading State ( including 26 states) to file an anti immigration Law suit. So you know what kind of State your are living in. Please think twice if you are moving to 'Texas'.

NE_Patriots Most of the H1B cases are pretty straight and they go through without any issues. They will be looking in to two things at the time of interview - - Whether you have the required academic and professional qualification (as mentioned in I-140) - whether the company (petitioner) is legit The U.S. Embassy or Consulates do not stamp passports anymore (if you're talking about the stamps which they used to call Borough Visas). Thus, you will have to apply, be psychically present at the consulate or Embassy and qualify for the visa. H visa classification is waived from 'Foreign Country Residence Requirement' which helps the applicant to demonstrate their qualification. You may be prepared for any other issues, if any, eg; why you took so long to graduate, what was your status in between UG and graduation, DUI etc hope this is helpful.

NE_Patriots If you are married currently, you may mentioned your spouse's name in your DS-160. If you're not, it is better not to do so. Technically your family-member can apply for an H4 visa only once s/he becomes your spouse. If the interview schedule does not permit you to travel together (because of backlog), you may always request for an expedited appointment as H classification are considered as high priority visa class. Visa appointments wait time usually go up to 3 weeks during summer (march to July).
