Applying for F-2 for spouse while the other is on F-1 should not be a problem. However F-2 will be granted only till the extent of the validity of OPT. You need to establish the following for our spouse: 1. Bona Fide Married Relationship 2. Sufficient funds to support the spouse while in the US 3. Employed under OPT and having received pay checks 4. Intent to return to home country upon completion of OPT period Talk to your International student Advisor, they will issue you a F-2 I-20 for your spouse. Tell your spouse to apply for F-2 ONLY till the period valid. Send copies of all I-20s, OPT, SSN, Pay Checks, Invitation letter from the school (if possible), Employment Contract, Bank Statement/Balance in the US or in home country. The spouse , if employed in home country should show leave approval letters, evidence of employment, property documents, educational leave etc to show compelling evidence that she will return. Santosh Giri ji, thank you for the information. I am not clear about "Bona Fide Married Relationship." I was married in a very traditional way. I do not have any legal documents that proves my marriage to her; however, we are still in touch with pandit who conducted our marriage. Can she take Pandit, along with her, to the visa interview to prove the authenticity of our marriage? Please suggest. Thank you

Bona Fide Married Relationship MEANS you actually married rather than court marriage to bring someone to USA. To prove that you married ask your write to take all the photo albums and CDs that you have to the embassy. They do not trust the marriage certificate anymore. Also photo like that of jagya, sindur haleko, kanyadan etc etc are the one they look for. You might laugh but it it the truth. Also another thing your wife might face is that" your husband graduated, he will come back home why do u have to go to US?" Think an answer for that question too. Good Luck and all the best.

Borka_r : So I can prove my marriage by using photoshop? That is less hassle than them court certificates. Kalankisthan: Yes, Santosh answered my question. He is an expert but only thing that I doubt about him is that he addressed MY Spouse as "our spouse." So, it is little hard for me to trust him.

Sorry about that !!!! Typo......but a typo enough to mean something else !!! Sorry once again ! I am no expert...just sharing those things which I have known during the short span of time I have been in the US. Believe me, I was blank about US immigration laws an policies before July 2005. After I came here, I came to know about the laws partly because of my personal immigration situations and mostly because of the classes I took. Still looking forward for the February 2008 Bar Exam to name myself with a new email address nepaliattorney@gmail.com from the present nepalilawyer@gmail.com.
